Acceptance of Terms
By using Nowkha International’s website, booking portal or services (“Nowkha”, “we”, “us”), you agree to be bound by these Terms & Conditions. If you do not accept these Terms, please do not use our services.
Services Provided
Nowkha provides transportation and logistics services including air, sea and land carriage, parcel handling, tracking, customs assistance, and related customer support. The particular service and service level (e.g., Economy, Premium) will be set out on the booking confirmation or invoice.
Rates, Payment & Charges
- Rates quoted exclude taxes, duties, customs fees, surcharges (fuel, security, peak, port, or regulatory fees) which the sender or consignee is responsible for paying.
- Payment terms are agreed at booking. Shipments may be held until all shipping charges and related fees are paid. Failure to pay may result in delay or disposal per local law.
Packaging, Labelling & Accurate Information
- The shipper is responsible for proper packing, securing and labelling of items. Items must be packed to withstand normal handling and transport.
- Shipper must provide complete and accurate information (contents, weight, dimensions, value, any special handling requirements, and contact details). Incorrect or incomplete information may result in additional charges, delay, or refusal.
Prohibited & Restricted Items
- Shipments must not include prohibited items as defined by applicable law or carrier rules (e.g., explosives, illegal narcotics, unauthorized hazardous materials, counterfeit goods, etc.).
- Restricted or regulated items (e.g., certain batteries, controlled medicines, perishables requiring special permits) require prior disclosure and approval and may require specific packaging or documentation. Non-disclosure may result in refusal, seizure, fines, or disposal. (See standard carrier prohibited items lists.)
Customs, Duties & Regulatory Compliance
- For international shipments, the shipper and consignee are responsible for providing accurate export/import documentation and complying with customs, export controls, sanctions and other regulations.
- Nowkha may act as an agent in facilitating customs clearance but is not responsible for customs delays or duties assessed by authorities. Any fines, penalties or duties are payable by the shipper/consignee.
Liability Limits & Insurance
- Unless otherwise agreed in writing, carriage is performed on a limited liability basis. Nowkha’s liability for loss, damage or delay is limited in accordance with applicable laws, the waybill terms, or the carrier’s published limits.
- Additional insurance can be arranged at the shipper’s request and expense for higher protection. We recommend purchasing declared value coverage for high-value items.
- Nowkha is not liable for indirect, consequential, or exemplary damages (e.g., loss of profits, business interruption) except where mandatory by law.
Claims, Time Limits & Evidence
- All claims for loss or damage must be made in writing to Nowkha within the timeframes specified in the waybill or applicable law (typically within 7–30 days for damage or loss; see our claims process). Late claims may be rejected.
- Claims must include the waybill number, photos of damage, packing evidence, and proof of value. Nowkha reserves the right to inspect the damaged shipment and packing.
- No claim will be accepted unless all shipping charges have been paid.
Delivery & Failed Delivery Attempts
Nowkha will attempt delivery to the consignee at the provided address. Where delivery attempts fail (no one available, incorrect address, refused delivery), Nowkha may attempt re-delivery, hold at a depot for collection, or return to sender as per arrangement. Re-delivery or storage charges may apply.
Delay & Force Majeure
Nowkha is not liable for delays caused by events beyond its reasonable control including but not limited to: natural disasters, strikes, acts of government, pandemics, port congestion, adverse weather, or carrier shutdowns.
Data & Privacy
We collect and process personal data necessary to provide the service (sender/receiver contact details, shipment data, payment details). Processing is done in accordance with our Privacy Policy, which forms part of these Terms. You consent to such processing by using our services. (See Nowkha Privacy Policy.)
Intellectual Property & Website Use
You may use our website and platform only for lawful booking and information purposes. All site content, logos and trademarks are Nowkha’s property. Reproduction or misuse is prohibited.
Amendments & Service Changes
Nowkha reserves the right to modify services, rates, or these Terms at any time. Updated Terms will be posted on our website and will apply to future bookings. It is the user’s responsibility to review the Terms periodically.
